What is section 43 of the employment Act?
As you are in Pakistan and want to know about jobs, this question is not easy due to the fact that the Employment Act is a title that many other countries use, but Pakistan does not have only one law with that name.
Section 43 is, however, very popular in three of the three regions that apply to you: the UK (popular in terms of legal queries), the UAE (Popular in terms of Pakistani expatriates), and Kenya (popular in search results).
The following is a breakdown of the meaning of Section 43 in each of the contexts, so you can locate the one that is applicable to you.
1. UK Law (Most Likely)?)- If you are enquiring about this, it is probably UK Law.
Act: Employment Rights Act 1996*
Title: Whistleblowing (Protected Disclosures).
Section 43 in the UK is well-known since it safeguards the so-called Whistleblowers. It makes sure that in case the employee claims a crime or a threat at the workplace, then he or she cannot lose his or her job.
You are safeguarded by law if you reveal information concerning:
- A criminal offense (e.g., your boss is robbing you).
- A health and safety hazard (e.g., the floor of the factory is not safe).
- Destruction of the environment (e.g., deposition of chemicals in a river).
- A miscarriage of justice.
- The “Public Interest” Rule: You need to think that you are acting on the public interest, not a personal grievance about your pay.
- Importance to you: In case you are writing a blog for a global audience, it is a huge subject of Whistleblowing. The fact that the fines are not capped has terrified companies from contravening Section 43.
2. When talking of UAE / Dubai Jobs (For Expats)?
Act: UAE Labour Law (Federal Decree-Law No. 33 of 2021).
Subject: **Quitting or Firing Notice Period.
This is the most significant part for the Pakistanis who are based in Dubai or Saudi Arabia. Article (Section) 43 controls the Notice Period in case of a job termination.
Rule: The employer or the employee may terminate the contract; however, they are obliged to provide written notice.
Time Limit: The time of the notice cannot be less than 30 days or more than 90 days.
Salary: You are supposed to receive your full remuneration throughout the period of the notice, and you also have to work throughout the period (except when your boss informs you otherwise).
The Penalty: In case you do not give a notice (i.e., you leave in 2 days), then you need to provide the company with the same salary as a penalty for the notice period.
3. Suppose you are querying the Pakistan Law.
Act– *Industrial Relations Act, 2012 (No single Employment Act)
Title: Illegal Strikes and Lock-outs.
The labor laws in Pakistan are divided into various acts (such as the Factories Act or the Shops Ordinance). But, in Section 43 of the Act of Industrial Relations, the topic of Illegal Strikes is addressed.
What it states is that a strike or a so-called lock-out (the bosses shutting down the factory as a way of disciplining the workers) shall be considered illegal in case it commences without going through the legal procedures (such as notice to the Labour Court).
The Consequence: Employees involved in an illegal strike may either be dismissed or fined.
